OBJET<br \/>\n<br \/>\nLe Guide MyTable r\u00e9f\u00e9rence des chefs priv\u00e9s en France afin de mettre en relation des clients avec des professionnels de la gastronomie priv\u00e9e.<br \/>\n<br \/>\n2. CONDITIONS D\u2019ADH\u00c9SION<br \/>\n<br \/>\nPour \u00eatre r\u00e9f\u00e9renc\u00e9 sur le Guide MyTable, vous devez :<br \/>\n<br \/>\n\u00catre un chef priv\u00e9 exer\u00e7ant une activit\u00e9 l\u00e9gale en France.<br \/>\nFournir des informations exactes et \u00e0 jour.<br \/>\nOffrir des prestations de qualit\u00e9, conformes aux engagements pris avec vos clients.<br \/>\nLe Guide se r\u00e9serve le droit de refuser ou de retirer un profil ne respectant pas ces conditions.<br \/>\n<br \/>\n3. RESPONSABILIT\u00c9S DU CHEF PRIV\u00c9<br \/>\n<br \/>\nEn vous inscrivant, vous acceptez de :<br \/>\n<br \/>\n-Respecter les lois en vigueur (hygi\u00e8ne, fiscalit\u00e9, etc.).<br \/>\n-Garantir la satisfaction et la s\u00e9curit\u00e9 des clients.<br \/>\n-Mettre \u00e0 jour votre disponibilit\u00e9 et vos offres sur demande.<br \/>\n-R\u00e9pondre aux demandes de r\u00e9servation dans un d\u00e9lai raisonnable : en l'absence de r\u00e9ponse de votre part sous 24h  apr\u00e8s r\u00e9ception d\u2019une demande de r\u00e9servation, le Guide MyTable se r\u00e9serve le droit d'informer le client que vous d\u00e9clinez la proposition en cours et de le rediriger vers d'autres Chefs disponible pour son \u00e9v\u00e8nement .<br \/>\n-Ne pas utiliser le Guide pour promouvoir des services non autoris\u00e9s.<br \/>\n4. COMMISSION ET PAIEMENT<br \/>\n<br \/>\n4.1.Autofacturation et encaissement des prestations<br \/>\nDans le cadre des r\u00e9servations effectu\u00e9es via le Guide MyTable, la soci\u00e9t\u00e9 Guide MyTable agit en qualit\u00e9 d\u2019interm\u00e9diaire entre le chef priv\u00e9 et le client final.<br \/>\n<br \/>\nEn validant son adh\u00e9sion au Guide MyTable et en cochant la case pr\u00e9vue \u00e0 cet effet lors de son inscription, le chef priv\u00e9 autorise express\u00e9ment la soci\u00e9t\u00e9 Guide MyTable \u00e0 \u00e9tablir, en son nom et pour son compte, les factures relatives aux prestations r\u00e9alis\u00e9es aupr\u00e8s des clients mis en relation par l\u2019interm\u00e9diaire du Guide MyTable, conform\u00e9ment au m\u00e9canisme d\u2019autofacturation pr\u00e9vu \u00e0 l\u2019article 289 I-2 du Code g\u00e9n\u00e9ral des imp\u00f4ts.<br \/>\n<br \/>\nLes factures \u00e9mises dans ce cadre mentionneront explicitement qu\u2019il s\u2019agit de factures \u00e9tablies par un tiers pour le compte du prestataire (\u00abFacture \u00e9mise par MyTable pour le compte du prestataire \u2013 Autofacturation \u00bb) et seront transmises au chef priv\u00e9 par voie \u00e9lectronique.<br \/>\n<br \/>\nLe chef priv\u00e9 reconna\u00eet conserver l\u2019enti\u00e8re responsabilit\u00e9 de ses obligations fiscales et sociales, notamment en mati\u00e8re de d\u00e9claration de chiffre d\u2019affaires, de TVA le cas \u00e9ch\u00e9ant, et de cotisations sociales. Il s\u2019engage \u00e0 v\u00e9rifier l\u2019exactitude des informations figurant sur les factures \u00e9tablies pour son compte et \u00e0 signaler sans d\u00e9lai toute anomalie.<br \/>\n<br \/>\nCette autorisation d\u2019autofacturation est consentie pour toute la dur\u00e9e de l\u2019adh\u00e9sion au Guide MyTable. Elle peut \u00eatre r\u00e9voqu\u00e9e \u00e0 tout moment par demande \u00e9crite adress\u00e9e \u00e0 contact@guidemytable.fr, sans effet r\u00e9troactif sur les prestations d\u00e9j\u00e0 r\u00e9alis\u00e9es ou en cours de traitement.<br \/>\n<br \/>\n4.2. Modalit\u00e9s de paiement au chef<br \/>\nPour chaque r\u00e9servation effectu\u00e9e via le Guide, une commission de 15 % HT est appliqu\u00e9e sur le montant total de la prestation.<br \/>\nCette commission est automatiquement d\u00e9duite avant le versement du paiement au chef priv\u00e9.<br \/>\nModalit\u00e9s de paiement<br \/>\nLe paiement au chef priv\u00e9 est effectu\u00e9 via virement bancaire.<br \/>\nLe versement est r\u00e9alis\u00e9 sous 7 jours ouvr\u00e9s apr\u00e8s la prestation.<br \/>\nLe chef priv\u00e9 doit fournir des informations de paiement valides pour recevoir son r\u00e8glement.<br \/>\n<br \/>\n5. POLITIQUE DU GUIDE<br \/>\n5.1. Annulation et remboursement<br \/>\nAnnulation par le client : En cas d\u2019annulation par le client, des frais peuvent \u00eatre appliqu\u00e9s en fonction du d\u00e9lai d\u2019annulation.<br \/>\nAnnulation par le chef priv\u00e9 : En cas d\u2019annulation par le chef apr\u00e8s confirmation, il devra notifier imm\u00e9diatement le client et le Guide. Des p\u00e9nalit\u00e9s peuvent \u00eatre appliqu\u00e9es en cas d\u2019annulations r\u00e9p\u00e9t\u00e9es.<br \/>\nRemboursement : Les modalit\u00e9s de remboursement sont d\u00e9finies au cas par cas selon la situation. La commission du Guide peut \u00eatre retenue si l\u2019annulation intervient apr\u00e8s une validation ferme.<br \/>\n5.2. Gestion des litiges<br \/>\nLe Guide n\u2019intervient pas directement dans les litiges entre chefs priv\u00e9s et clients. Toutefois, une m\u00e9diation peut \u00eatre propos\u00e9e en cas de besoin.<br \/>\nLes chefs priv\u00e9s doivent faire preuve de bonne foi et chercher une solution amiable en cas de d\u00e9saccord avec un client.<br \/>\n5.3. Modifications du profil<br \/>\nLe chef priv\u00e9 peut demander des modifications de son profil \u00e0 tout moment via le formulaire de contact sur le site MyTable ou \u00e0 l'adresse mail suivante : contact@guidemytable.fr<br \/>\nLe Guide se r\u00e9serve le droit de modifier ou supprimer tout contenu non conforme \u00e0 son image ou \u00e0 sa ligne \u00e9ditoriale.<br \/>\n6. R\u00d4LE DU GUIDE<br \/>\n<br \/>\nLe Guide agit en qualit\u00e9 d\u2019interm\u00e9diaire technique et financier mais ne garantit pas les r\u00e9servations ni la qualit\u00e9 des prestations. Il n\u2019est pas responsable des litiges entre un chef et un client.<br \/>\n<br \/>\n7. UTILISATION DES DONN\u00c9ES PERSONNELLES<br \/>\n<br \/>\nLes informations fournies sont utilis\u00e9es uniquement pour r\u00e9f\u00e9rencer votre profil et faciliter les mises en relation. Elles ne seront pas vendues \u00e0 des tiers.<br \/>\n<br \/>\n8. MODIFICATION ET R\u00c9SILIATION<br \/>\n<br \/>\nLe Guide peut modifier ces conditions \u00e0 tout moment et notifiera les chefs r\u00e9f\u00e9renc\u00e9s.
